This rate is for a year and can be modified for shorter terms; i.e.:
 
          6 month plus one day rate is yearly rental rate times 1.25;
 
          3 mo. rate is the yearly rate times 1.5 plus 11.0% tax;
 
 
 
SEASONAL RATES
 
This is a vacation rental for a furnished unit and:
 
          Is taxed if for less than 6 months plus one day; 
 
   May include averaged utility allowances;
 
          Typically includes all household items; and,
 
          On townhomes/single families, utility costs will be added.
 
 

It wastes considerable time to negotiate for pricing leverage by inappropriately applying terms for price vs. the actual
proposed rental conditions.

Some furnished long-term property owners willing to convert to seasonal will not accept an advance rental, as in more than 30 days in the future, as that seasonal rental would prevent a long-term rental.

Seasonal Rentals are typically 3 months or more; i.e., for the season vs. a vacation period.
Our seasonal/minimum rental periods are controlled by the following factors:
1. The minimum rental period as determined by a Condo/Home Owner's Association,
2. The minimum rental period as determined by Brevard County Ordinance, and/or
3. Our own business plan.
Aamerican Property Management as a courtesy we will be providing vacation renters with shorter term/vacation listings from the individual owners. Please thoroughly review our terms of use and policies prior to transacting any direct dealings.

The content below is a general guideline as to how most short term rentals are handled--however each owner will have their own policies. *Policies below are provided as a guideline*
RESERVATION INFORMATION
• In Season: November 1st - April 30th
• Out of Season: May 1st - October 31st
RESERVATION REQUEST
Initial security deposit & $40 application fee must be made with reservation (security amount is equal to rent amount).
Annual Terms of Payment
• Security Deposit equal to one month's rent and due at booking
• $40 Application Fee due at booking
• Monthly Rent due by 1st of the month.
We accept personal checks, money orders, online payment or cashier checks for rent payments after move-in.
Seasonal Terms of Payment
• 1/2 Security Deposit due at booking if prior to September 30th
• $40.00 - Application Fee due at booking
• Second 1/2 of the Security Deposit or all of the Security Deposit amount is due by October 1st.
• Rent + tax due at move-in**, exit cleaning fees are the actual cost of cleaning
• All payments received must be made by money order, check, bank transfer or *wire transfer.
*Wire transfer fees must be added.
** Money order, check, bank transfer, *wire transfer or pre-paid with personal check with sufficient clearance.
If Payment is not received on time or a check does not clear on-time, the contract will be null and void.
• All reservations are subject to approval by the Condominium/Homeowner's Association. Application forms and appropriate fees made payable to the Aamerican Property Management are to be submitted when confirming your reservation.
All payments must be made by money order, bank transfer, cashier's check or pre-arranged wire transfer prior to arrival. Payments made upon arrival must be made by certified check or money order only.
Recent Reservations
If you are making a reservation within 60 days prior to check-in, payment is due and can be made by certified check or money order, cashiers check, bank transfer or wire transfer.

FURNISHINGS/EQUIPMENT
All seasonal properties are individually owned and are decorated according to each owners’ taste. They are fully furnished and include sufficient basic kitchen ware, linens, television and telephones.
UTILITIES/TELEPHONE/CABLE/TRASH REMOVAL
An Electric AVERAGED MONTHLY ALLOWANCE, local phone service, basic cable and trash removal are typically included in the monthly rent for most seasonal rentals. Long distance charges are the responsibility of the Tenant. Calling cards will be needed, as phone blocks are installed on many phones. For single family homes and villas with heated pools, electric and pool gas will require an additional deposit and the average monthly ALLOWANCE AMOUNT will NOT be increased.
CLEANING AND HOUSEKEEPING SERVICES
Your unit will be cleaned and inspected prior to your arrival. Seasonal leases are responsible for the cost of a departure cleaning. Washers and Dryers are included in most units or you will have access to a common area facility. If additional housekeeping services are required, special arrangements can be made for an additional fee.
PET POLICY
Many Homeowner Associations have restrictions on tenants from having pets. If you have a pet, please be sure we are aware of it so we can find a location that allows pets. If there is not a restriction, then the owner can approve a pet.
SMOKING POLICY
All units are non-smoking unless otherwise noted.
UPON ARRIVAL
An inspection form will be provided to report any item that are damaged or not in proper working order. Please report any electrical, plumbing or appliance problem to our Rental Division at 775.9251.
ARRIVALS/KEY PICK-UP
Check-in time is 3:00 pm EST. A designated key pick-up location will be given prior to arrival. Two sets of keys will be provided for each unit, along with security gate, garage door openers, pool and mailbox keys (if applicable.)
DEPARTURE/KEY RETURN
Check-out time is by 11:59 am EST. Unit keys should be returned to your designated key pick-up location. Security gate, garage door openers, pool and mail keys should be left in the unit upon departure. Lost or unreturned keys will be charged against the tenants security deposit at association cost or a minimum rate of $25.00 per key. Late check-outs may be arranged with approval from the rental office for an additional hourly rate. In the winter months, late check-outs require a pre-approval; i.e., a day or more advance request.
DEPARTURE PROCEDURE
Please leave your accommodation as neat as possible. Dishes should be placed in the dishwasher and started. The last day’s linens and towels should be left for laundering only. Follow-up cleaning and laundry will be charged against your security deposit.
SECURITY DEPOSITS
Deposits are returned promptly after departure within 15 days from departure. Should it be determined you are responsible for excessive cleaning, carpet cleaning, damages or missing items, a Notice of Intent to make a Claim on the Security Deposit will be sent within 15 days after departure.
CANCELLATIONS
Cancellations and partial refunds may occur prior to the last day of September only when a parallel replacement tenant has been secured by that same last day of September and funds collected from the replacement tenant. Cancellations must be IN WRITING.

Good Housekeeping
It is prohibited to rearrange the furniture.
Your vacation property will be cleaned to quality standards prior to your arrival and after your departure. Maid service is not provided during your stay unless you make a request for those additional services. You are responsible for cleaning your vacation property during your stay and for leaving the property in good condition at check-out For example: wash the dishes, clean up spilled milk, juice, candy wrappers etc. Clean up a sticky floor. Put the iron and ironing board back in its proper place. Take all the trash to the dumpster. If the property is left damaged, unusually dirty and messy, you will forfeit your security deposit and will be charged additional fees to offset the expense of cleaning and/or repairs.
Refrigerator: Please do not overload the refrigerator with drink cans and bottles. Please do not reset the refrigerator setting to a low setting for a "quick cool" for drinks. This can cause problems with the refrigerator and restricts the refrigerator from cooling properly. If a service repairman is required, then the charges will be deducted from the security deposit. If the charges exceed the deposit, then additional payment is required by the guest.
Washer/Dryer: Please thoroughly shake out the sand from beach towels and swimsuits before washing/drying them in the washing machine. Sand causes problems in washer/dryers and a repairman may be required. If a repairman is required, then the charges will be deducted from the security deposit. If the charges exceed the deposit, then additional payment is required by the guest.
Please do not take the property's bath towels or linens to the beach. Please bring your own beach towels. If beach towels or other colorful items are wash/dried with the property's towels/linens, then replacement charges of the affected towels/linens will be deducted from the security deposit. If the charges exceed the deposit, then additional payment is required by the guest.
Linens/Towels/Supplies. The property provides basic towels/linens and starter supply of trash liners, bathroom paper and soap. However, guests will need to provide their own laundry detergent, additional paper products and household supply items for their stay.
Trash Disposal. Please place trash in trash bags and dispose of trash at the dumpster at the resort during your stay. Maravilla Resort homes and Beach Retreat Cottages are offered EARLY MORNING trash pick up on Monday and Thursday. Otherwise, please dispose of your trash at the dumpster during your stay. Prior to check-out, all guests are required to dispose of all food trash and garbage at the dumpster located in the resort.
The condo or home must be left in good condition. All soiled dishes must be washed in the dishwasher or by hand prior to departure. Owners typically reserve the right to retain partial or full security deposit for late departure, carpet cleaning or additional housekeeping services due to guest's lack of care or respect for privately owned properties. Additional charges may apply to offset deep cleaning, damage and/or theft. Please treat the property with care and the neighbors with courtesy.
The vacation properties may have a locked closet(s) that is reserved for storage for the owner's personal items. The locked closet is NOT included in the rental.


ARTICLE H. OCCUPATIONAL LICENSE TAX*
DIVISION 1. GENERALLY
See. 102.26. Definitions.
The following words, terms and phrases, when used in this article, shall have the* meanings ascribed to them in this section, except where the context clearly indicates a different meaning:
Business, business location, profusion and oc­cupation do not include the customary religious, charitable or educational activities of nonprofit religious, nonprofit charitable and nonprofit edu­cational institutions in this state, which institu­tions are more particularly defined and limited as follows:
Charitable institutions means only nonprofit corporations operating physical facilities in this state at which are provided charitable services, a reasonable percentage of which shall be with­out cost to those unable to pay.
Educational institutions means state tax-supported or parochial, church and nonprofit schools, colleges, or universities conducting reg­ular classes and courses of study required for accreditation by or membership in the Southern Association of Colleges and Schools, the Department of Education or the Florida Coun­cil of Independent Schools. Nonprofit libraries, art galleries and museums open to the public are defined as educational institutions and eligible for exemption.
Religious institutions means churches and ecclesiastical or denominational organizations or established physical places for worship in this state at which nonprofit religious services and activities are regularly conducted and car­ried on, and shell also mean church cemeteries.
"Business location” means each separate place of business used by or address given by the person who will carry on, engage in or conduct any business, profession or occupation, as well as anylocation in which such person stores equipment or inventory, or regularly conducts a portion of his business activities, Business location shall also mean any separate place where the applicant, his agents or employees regularly park motor vehi­cles used in or related to the conduct of the business. Business location shall also mean any location at which are maintained separate corpo­rate divisions, individual retail outlets, separate branch offices or other essentially separate and complete entities or professional or occupational locations.
Clarification means the method by which a business, business location or group of businesses or business locations is identified by size or type, or both.
Local governing authority means the governing body of the county or any incorporated municipal­ity in the county.
Local occupational license means the method by which a local governing authority grants the privilege of engaging in or managing any busi­ness, business location, profession or occupation within its jurisdiction. It shall not mean any fees or licenses paid to any board, commission or officer for permits, registration, examination or inspection. Unless otherwise provided by law, these are deemed to be regulatory and in addition to, and not in lieu of, any local occupational license imposed under the provisions of this arti­cle.
PERSON means any individual, firm, partner­ship, joint adventure, syndicate, or other group or acting as a unit, association, corporation, estate, trust, business trust, trustee, exec­utor, administrator, receiver, or other fiduciary, and shall include plural as well as singular, but shall not include cities, counties, municipalities, or other local governmental agencies or bodies.
Taxpayer means any person liable for taxes imposed under the provisions of this article, any agent required to file and pay any taxes imposed under this article, and the heirs, successors, as­signees and transferees of any such person or agent. (Code 1979, § 21-16)

Sec. 102-27. Penalty.
Any person who shall carry on, engage in or conduct any business, business location, profes­sion or occupation for which a license is required under the provisions of tins article without first obtaining such license, or who falsifies informa­tion on a license application, shall be punished as provided in section 1-7. (Code 1979, 21-25)
See. 102-28. Authority to levy.
The county hereby levies an occupational li­cense tax for the privilege of engaging in or managing any business, business location, profes­sion or occupation within the county authorized pursuant to F.S. ch. 205. (Code 1979, § 21-15(1))

No county occupational license or county occu­pation license tax is required from those ex­empted by state law from same. (Code 1979, §{ 21-28-21-33)
Section 62-194S.2. Resort dwellings.
Where a resort dwelling is listed as a conditional use in certain residential zoning classifications, it must meet the following qualifying conditions:
1. Location Standards - Resort dwellings shall be restricted to parcels that are:
a. located east of State Road AIA but not abutting any single family detached uses or lots zoned
for single family detached uses, or
b. located on the west side and having direct frontage on State Road AIA, but not abutting any
single family detached uses or lots zoned for single family detached uses.
2. Performance Standards - All resort dwellings qualifying under this section shall meet the following performance standards. These performance standards shall be included in the rental agreement and conspicuously posted inside the unit
a. Parking. For single family resort dwellings, there shall be at least one designated and available
off-street parking space for each bedroom in the residence. Occupants shall not park their
vehicles on the street
b. Maximum occupancy. The number of persons occupying the resort dwelling at any given time
shall not exceed vie number of rooms in the residence, as established by a submitted floor plan.
The maximum occupancy of the structure shall be established by the Planning and Zoning
Office at the time of occupational license review.
c. Excessive or late noise. Noise emanating from the resort dwelling shall not disturb the peace
and quiet of the vicinity in which the residence is located. Any noise whose measurement
exceeds the sound level limits set forth for residential zoning in Section 62-2271 or violates the
provisions of Chapter 46, Article IV is considered excessive noise. Additionally, sounds
produced from any radio, stereo, television, amplifier, musical instrument, phonograph or
similar device shall not be discernable at the property line of the resort dwelling after 10:00 PM
and before 7:00 AM.
d. Local management. Each resent dwelling shall have a designated local manager. The local
manager shall be a permanent resident of Brevard County and shall be available 24 hours a day,
7 days a week, to address neighborhood complaints, The local manager's name and telephone
number shall be registered with the Planning & Zoning Office and shall be posted on the
property ma manner visible from the street
e. Manager's responsibility. The local manager is responsible for assuring compliance with the
performance standards in this section. The local manager shall satisfactorily address complaints
by concerned residents of violations of the performance standards (2a., 2.b., and 2.c.) in this
section within one hour of receipt of the complaint
f. Penalty. In addition to the penalties enumerated in Chapter 2, Article VI, Division 2 of the
Brevard County Code, the code enforcement special magistrate may suspend or revoke the
resort dwelling's occupational license under the following conditions: If the special magistrate
finds a violation or recurring violation of this Section, the special magistrate may suspend the resort dwelling's occupational license for a period of not more than thirty (30) days or until the issue is resolved, whichever is later, and if die special magistrate finds a repeat violation of this section or a violation of a suspension order, the special magistrate may revoke the resort dwelling's occupational license. Revoked licenses may not be reissued for a period of one year from the date of revocation. Additionally, the County may enforce this section by any other means provided by law.
